Article 1– This seasonal rental contract is reserved exclusively for the rental ‘La Rose des Vents, Canaveilles’.

Article 2Length of the stay: The tenant signing this contract for a specific length of time cannot in any way exercise a right to remain in the accommodation at the end of the stay.

Article 3 – Conclusion of contract: Booking becomes effective when the tenant has paid the full amount for the rental period.

The rental concluded between the two parties can in no case be used by other persons without the owner’s written approval. Breach of this article may lead to the immediate termination of the rental and the total amount of the rental will be due the owner.

Article 4 – Cancellation by tenant: All cancellations must be notified to the owner.

a)     Cancellation before arrival:

No refund will be issued if the cancellation is made less than 45 days before the date of entry into the accommodation. 50% may be issued should cancellation be made 45 days ahead of entry into the accommodation.

If the tenant does not show up within 24 hours of the date of arrival on the contract, this contract is null and void and the owner is free to dispose of his gîte. The rental amount is not refundable and the total amount of the rental will be due to the owner.

b)     In case of a shortened stay: The amount of the rental remains due to the owner, and there will be no refund for the tenant.

Article 5 – Cancellation by the owner: The owner returns the full amount paid by the tenant.

Article 6 – Arrival: The tenant must arrive on the day and at the time agreed. In case of late or delayed arrival, the tenant must warn the owner.

Article 7 – Cleaning: The cleanliness of the gîte when the tenant enters is to be noted by both the tenant and the owner or owner’s representative. The tenant is responsible for cleaning the gîte during his stay and before leaving. The tenant will leave the gîte in the same state of tidiness and cleanliness as when they arrived and leave all dirty linen on the beds. Should the tenant fail to do so then the owner reserves the right to charge a cleaning fee, the current rate being €20 per hour.

Article 8 – Deposit: When the tenant arrives, a security deposit of €400 is requested by the owner. After the final inventory, just before leaving, this deposit is fully refunded except in the case of damage or deduction of cleaning fee. In the case of a stay being cut short thus rendering an inventory impossible, the security deposit will be returned to the tenant as soon as realistically possible.

Article 9 – Use of the accommodation: The tenant must ensure the peaceful nature of the accommodation and use it for its established purpose.

Article 10 – Capacity: This contract is drawn up for a maximum number of people agreed at the time of booking. If the number of tenants exceeds this capacity, the owner has the right to refuse the extra persons. The tenant will be considered liable for any modification or breach of contract.

Article 11 – Pets: This contract stipulates that the tenant is not allowed to bring pets. If the tenant does not respect this clause, the owner can deny access to the gîte. In this case, no refund will be made.

Article 12 – Insurance: The tenant is responsible for all the damages of his doing. He must have an insurance policy to cover these different risks.

Article 13 – Payment of charges: At the end of the stay, the tenant must pay the charges not included in the price. The tenant will be informed of any charges prior to arrival by the owner.

 Article 14 – Claims: Any complaint related to the inventory or differences between the description and the actual rental, must be lodged with the owner or owner’s agent within 3 days of the start of the contract. Any other claims must also be adressed as soon as possible by letter.
